Indiana Immigration Laws

Indiana requires state and local government agencies and public contractors to use E-Verify. Private employers are not mandated but receive tax credit incentives for voluntary use. Indiana does not issue driver's licenses to undocumented immigrants and restricts local sanctuary policies. Undocumented students are classified as out-of-state for tuition purposes and are ineligible for state financial aid.

No Driver's Licenses for Undocumented ImmigrantsInd. Code § 9-24-9

Indiana requires proof of lawful presence for driver's license applicants. Undocumented immigrants cannot obtain a driver's license or state ID.

Sanctuary Policy RestrictionsInd. Code § 5-2-18.2

Indiana restricts local governments from adopting sanctuary policies. Law enforcement agencies must generally comply with ICE detainer requests. Additional enforcement legislation actively pursued in 2025-2026.

Out-of-State Tuition for Undocumented StudentsInd. Code § 21-14-11

Since July 2011, undocumented students are classified as out-of-state for tuition purposes at public colleges and universities. They are not eligible for state financial aid.
