Immigration law is primarily federal, but Florida has taken one of the most enforcement-oriented approaches among states. SB 1718 (2023) banned sanctuary city policies statewide, requires E-Verify for employers with 25+ employees, and bars driver's licenses for undocumented residents. In-state tuition benefits for undocumented students were repealed in 2025. Federal labor protections still apply to all workers regardless of immigration status.

Key Florida Statutes
Florida prohibits sanctuary city policies statewide and requires full cooperation with federal immigration enforcement (ICE). Local governments cannot provide funds for organizations issuing identification documents to undocumented persons.
Employers with 25 or more employees must use the E-Verify system to verify employment eligibility. Non-compliance can result in license suspension or revocation.
Florida does not issue driver's licenses or ID cards to undocumented residents and does not recognize driver's licenses issued by other states to undocumented persons.
Federal labor laws including minimum wage, overtime, and workplace safety protections apply to all workers regardless of immigration status. Florida's state minimum wage also applies to all workers.
In-state tuition waivers for undocumented students were repealed during Florida's 2025 legislative special session. This benefit is no longer available.
