Illinois Immigration Laws

Immigration law is primarily federal, but Illinois has some of the strongest state-level protections for immigrants in the country. The TRUST Act restricts law enforcement cooperation with federal immigration authorities. Illinois provides driver's licenses to all residents regardless of immigration status and has a state DREAM Act providing scholarships. The state also limits E-Verify usage and bans private immigration detention centers.

Key Illinois Statutes

Illinois TRUST Act (Sanctuary Protections)5 ILCS 805

Restricts state and local law enforcement from cooperating with federal immigration enforcement. Prohibits honoring ICE detainer requests absent a judicial warrant.

Driver's Licenses for All Residents625 ILCS 5/6-105.1

Standard driver's licenses are available to all residents regardless of immigration status (effective July 1, 2024, replacing the separate TVDL system). Licenses are marked "Federal Limits Apply." The Secretary of State is prohibited from sharing driver information with immigration officials absent a warrant.

Illinois DREAM Act110 ILCS 947

Illinois was the first state to create a private scholarship fund for undocumented students. Makes scholarships, 529 college savings plans, and prepaid tuition programs available to undocumented students who graduated from Illinois high schools.

Worker Protections (E-Verify Limits)820 ILCS 55 (Right to Privacy in the Workplace Act)

Prohibits employers from using E-Verify in ways not required by federal law. Workers' compensation and wage protections apply to all employees regardless of immigration status.
