Minnesota Immigration Laws

Immigration law is primarily federal, but Minnesota has several state-level protections and resources that affect immigrants. Minnesota does not require proof of immigration status for state benefits like emergency medical care and K-12 education. The state has also enacted workplace protections specific to immigrant workers.

State Services Regardless of Immigration StatusMinn. Stat. § 256B.06

Minnesota provides emergency Medical Assistance to all residents regardless of immigration status. Children and pregnant individuals may qualify for additional coverage.

Driver's Licenses for All ResidentsMinn. Stat. § 171.06 (Driver's License for All law)

As of October 2023, Minnesota allows all residents to obtain a standard driver's license regardless of immigration status.

Wage Theft ProtectionMinn. Stat. § 181.03

Minnesota's wage theft law protects all workers regardless of immigration status. Employers cannot use immigration status as a defense against wage claims.

Prohibition on Sanctuary City RetaliationMinn. Stat. § 299A.01 (various provisions)

Several Minnesota cities and counties have adopted policies limiting cooperation with federal immigration enforcement in certain circumstances.
