Washington Immigration Laws

Washington is a sanctuary state under the Keep Washington Working Act (2019). State law prohibits local law enforcement from cooperating with voluntary ICE holds, sharing nonpublic data with ICE, or asking about immigration status outside criminal investigations. Standard driver's licenses do not require proof of lawful status. E-Verify is not required for private employers or public contractors. In-state tuition and state financial aid are available to undocumented students.

Prohibits local law enforcement from complying with voluntary ICE detainer holds, sharing nonpublic personal data with ICE, asking about immigration status (except for criminal investigations), or entering agreements to enforce federal immigration law.

State Agency Immigration RestrictionsRCW 43.17.420, RCW 43.17.425

State agencies are restricted from collecting or sharing immigration/citizenship status information.

Driver's Licenses (No Status Requirement)RCW 46.20.035

Washington does not require proof of lawful immigration status or citizenship for a standard driver's license. All residents are eligible regardless of immigration status. Commercial driver's licenses (CDLs) do require lawful status.

Motor Vehicle Data PrivacyRCW 46.12.630

Governs disclosure of vehicle/vessel owner registration lists. State agencies are separately prohibited from using any data (including motor vehicle records) for immigration surveillance under RCW 43.17.425.

In-State Tuition & Financial AidRCW 28B.15.012(2)(e)

Undocumented students who completed their senior year at a WA high school, earned a diploma/GED, and resided in WA 3+ consecutive years are eligible for in-state tuition. SB 5194 (2021) expanded eligibility and added access to state financial aid.
