Mississippi Immigration Laws

Mississippi has one of the most restrictive state-level immigration enforcement postures in the country. Senate Bill 2710 (2017) bans all sanctuary city policies. Mississippi requires ALL employers (public and private) to use E-Verify under the Mississippi Employment Protection Act — one of the strictest mandates in the nation. Undocumented residents cannot obtain driver's licenses, in-state tuition, or state benefits. Mississippi has active 287(g) agreements with ICE.

Key Mississippi Statutes

Anti-Sanctuary LawSB 2710 (2017), effective July 1, 2017

Prohibits state agencies, cities, counties, and educational institutions from enacting sanctuary policies that limit cooperation with federal immigration enforcement. Local governments cannot prohibit employees from inquiring about immigration status.

E-Verify (All Employers)Miss. Code Ann. § 71-11-3 (Mississippi Employment Protection Act)

ALL employers (public and private) must use E-Verify to verify work eligibility of new hires. Effective July 1, 2011. Penalties include public contract cancellation, up to 3-year ineligibility for public contracts, and business license revocation for up to 1 year.

Driver's LicensesMississippi DPS Requirements

Lawful immigration status is required for a Mississippi driver's license or ID card. All non-U.S. citizens must be verified through SAVE. Undocumented residents are not eligible for any form of state-issued ID.

In-State Tuition / State BenefitsState policy (no statutory authorization)

Mississippi does not provide in-state tuition to undocumented students regardless of length of residency. No state-funded benefits are available to undocumented residents.
