Wisconsin Immigration Laws

Wisconsin takes a mixed approach to immigration. There is no state-level E-Verify mandate for private employers (though legislation is pending). Undocumented immigrants cannot obtain driver's licenses. Several cities (Milwaukee, Madison) have adopted immigrant-friendly policies, though DHS designated them as sanctuary jurisdictions in 2025. In-state tuition for undocumented students was allowed briefly (2009) but repealed in 2011.

Undocumented immigrants cannot obtain a Wisconsin driver's license. DACA recipients can obtain a license. Legislative proposals to expand eligibility have been introduced but not passed.

Wisconsin has no state E-Verify mandate for private employers. Pending legislation (SB 287) would require E-Verify for state contractors on projects worth $50,000+ and for state/local government hiring. Not enacted as of February 2026.

No state-level sanctuary law, but Milwaukee County (Immigrant Protection Ordinance) and Madison (General Ordinance 23.63) have local policies limiting immigration enforcement cooperation. DHS designated Milwaukee, Madison, Dane, and Shawano counties as sanctuary jurisdictions in 2025.
