Wyoming Immigration Laws

Immigration law is primarily federal, but Wyoming has taken a notably enforcement-oriented approach at the state level. Wyoming does not issue driver's licenses to undocumented immigrants and enacted a 2025 law invalidating out-of-state licenses issued to noncitizens without lawful status. Wyoming does not require E-Verify for employers (it is voluntary), does not offer in-state tuition to undocumented students, and has no sanctuary policies.

Driver's Licenses — Noncitizen RestrictionsHB 116 (2025); Wyo. Stat. § 31-7-122

Effective July 1, 2025, driver's licenses and identification cards issued by other states to individuals who cannot demonstrate lawful presence in the United States are invalid in Wyoming. Driving with such a license is a misdemeanor punishable by up to 6 months in jail and a $750 fine.

Wyoming does not require employers to use E-Verify. Employers must complete federal Form I-9 for all new hires but are not compelled to participate in the E-Verify electronic verification system.

No In-State Tuition for Undocumented StudentsWyoming policy
